How to prove FRAUDS when EC keeps all the records and documents?  Have an audit then it is meaningful for the Judges to know the frauds.  Please conduct RCI with full investigations by professionals.

EC: Opposition exploiting urban folks

EC deputy chairman Wan Ahmad Wan Omar also says that the opposition has no right to call for the resignation of the EC office bearers.
PUTRAJAYA: The much maligned Election Commission defended its corner by dismissing all claims of electoral fraud as alleged by Pakatan Rakyat and stresses that elections in Malaysia are free and fair.
Its deputy chairman Wan Ahmad Wan Omar told FMT in an interview that no one, including the EC, stopped any legitimate voter from voting.
“We didn’t stop candidates from contesting. We didn’t stop anyone from nominating themselves, no one stopped voters from voting during the GE13 and EC did not stop anyone from campaigning,” he said when met at his office in Putrajaya.
“The slanders of impromptu citizenship insult the intelligence of Malaysians as everyone knows that it is a difficult to obtain citizenship in Malaysia.”
“Claims on foreigners coming to Malaysia to vote is not fair to the government or home ministry. Why target Bangladeshis when Indonesian seems more convincing?” he asked.
According to Wan Ahmad, Malaysians should think over the accusations made by the opposition. He added that the people in the urban areas have been exploited for political mileage.
“If one claims there has been fraud in the elections, how is it possible for the big names to be defeated?”
“Ghani Othman, Raja Nong Chik and Ali Rustam were big names who lost in the election. One could see for themselves the contributions of the big names compared to what the winners have contributed and yet they won. It is the people’s choice at the end of the day,” he said.
Former Johor menteri besar Abdul Ghani Othman was defeated by Lim Kit Siang in Gelang Patah, resulting in the former’s political retirement.
Malacca’s ex-chief minister Ali was defeated in Bukit Katil by PKR Youth chief Shamsul Iskandar. Raja Nong Chik was among the big-name cabinet ministers who were defeated in the last GE. He lost to incumbent Lembah Pantai MP Nurul Izzah Anwar.
Wan Ahmad also rubbished claims of blackouts in polling centres, especially during vote counting period, saying that there were no police reports made on this matter.
“Many also spoke about missing ballot boxes and phantom votes. However the final results tallied with the ballots issued and Form 14. The forms were signed by the polling agents which were witnessed by the candidates’ representatives,” he said.
Credibility unaffected

He urged the public not to accuse the EC without evidence and to respect the decision of the majority who voted.
Wan Ahmad said EC’s reputation was not be damaged based on the slanders made by the opposition. He however left the matter to the authorities to decide.
“We follow the law and the constitution and if one chooses to accuse us, they should go by the law.”
He also said that the EC was leaving it to the police and the Malaysian Anti Corruption Commission (MACC) to investigate claims of political violence and bribery during the election period.
“Learning from the GE13, we do admit that there are flaws as nothing is perfect. However, we are beefing up and improving the existing regulations,” he said.
Responding to calls by the opposition for the EC hierarchy, including himself, to step down over their failure to conduct the elections ably, Wan Ahmad said it was more relevant for the Yang Di-Pertuan Agung to call for the EC’s resignation rather than by those “who do not follow the constitution or law”.
Wan Ahmad also pointed out that Article 118 of the Federal Constitution clearly stated that any quarter who disagreed with the election results could file a petition at the High Court.

(Reuters) - Malaysian Prime Minister Najib Razak may have won this month's disputed election but he faces a fight for legitimacy that could slow reforms, embolden a strong opposition protest movement and spark a leadership battle.
Already the signs are not good.
 
At a busy intersection across from one of Kuala Lumpur's fanciest shopping malls, a huge poster of Najib and his deputy has been defaced, a rare display of public disrespect in the Southeast Asian nation.
One of the comments scrawled on the poster poked fun at the unconvincing share of the votes won by Najib's long-ruling Barisan Nasional (BN) coalition: "47 percent PM."
"If you don't like it, you can leave," mocked another, alluding to a comment by Najib's new home minister that those unhappy with the May 5 poll result - and the electoral system that produced it - should pack up and emigrate.
The tense political atmosphere threatens to prolong policy uncertainty that investors hoped the polls would put to rest, as Najib braces for a possible leadership challenge and the opposition mounts a noisy campaign to contest the result.
By securing 60 percent of parliamentary seats with less than 50 percent of the popular vote, the BN's victory has served to expose starkly the unfairness of a gerrymandered electoral system that is also prone to cheating and bias.
That has galvanized the opposition, led by former deputy prime minister Anwar Ibrahim, into holding a series of big rallies as it refuses to accept the result and prepares legal action to challenge the outcome in nearly 30 close-run seats.
Disgruntled Malaysians have submitted more than 220,000 signatures to the White House online petition page, exceeding the number required for a response from President Barack Obama.
In response, divisions have appeared in the United Malays National Organization (UMNO), the main party in the ruling coalition - in power since independence from Britain in 1957.
Hardliners have urged a crackdown on dissent and blamed minority ethnic Chinese voters for deserting the ruling coalition. That has raised racial tensions in a country whose ethnic Malay majority dominates politics and enjoys special privileges to offset what its leaders see as its disadvantaged position compared to relatively wealthy ethnic Chinese.
ANGRY MALAYSIANS
Reformers have urged Najib to press ahead with social and economic reforms to blunt the opposition's appeal and address the concerns of discontented young and urban voters. That includes many ethnic Malays who voted for the opposition.
"Every day Najib sees angry Malaysians on the Internet. It is not an easy thing to swallow," said a senior government official who declined to be identified. "There are people in his cabinet asking for a crackdown and there are others asking for him to brandish his reformist side."
The hardliners appeared to gain ground last week when police used the colonial-era Sedition Act to detain three opposition politicians and activists and charged a student with inciting unrest.
The three arrested were later released after a court rejected the police remand order, but could still face charges.
Najib is under pressure from UMNO conservatives such as Mahathir Mohamad, who served as prime minister for 22 years, to show a tougher side ahead of a leadership election that could be held as early as August. At least until then, planned reforms such as steps to widen Malaysia's tax base and reduce heavy food and fuel subsidies are likely to stay on hold.
"Najib is not in a very strong position," Mahathir told reporters in Tokyo on Saturday, saying there was a risk that his majority could be weakened further if some ruling coalition politicians defected to the opposition.
"When you are concerned about that, the focus on development, economy and all that will be affected. That is Najib's problem."
FRAUD CLAIMS
The opposition has yet to present clear evidence of widespread fraud, but Reuters interviews with 15 polling agents give an indication of why many Malaysians have lost faith in an electoral system that clearly favors the governing coalition.
A majority said officials of the Election Commission (EC), which is part of the Prime Minister's Department, did not follow procedures or were ill-equipped to oversee the polls.
"Some, not all, officials were not trained enough or did not have the experience to determine what was a spoiled vote," said a counting agent in the Segamat parliamentary seat in southern Johor state, where the BN candidate won by a slim 1,200 majority with 950 votes deemed as spoiled.
"I cannot speculate on whether it was deliberate but there was quite a bit of incompetence," said the agent, who declined to be identified due to the sensitivity of the issue.
Anwar's three-party alliance says it has evidence that BN officials bought votes with cash and transported immigrants, who were granted citizenship on shaky grounds, to vote in areas with close races.
While its legal action, due to be filed with courts around the end of May, is unlikely to succeed, it will keep the electoral fraud issue in the spotlight for months ahead.
In Selangor state near Kuala Lumpur, a Reuters examination found at least 2,000 voters had identity cards deemed "dubious" by a commission of inquiry in Malaysia's Borneo island state of Sabah. That commission is investigating long-standing allegations that the ruling coalition handed out citizenship to immigrants for votes.
The government denies the fraud claims, accusing the opposition of being sore losers and of trying to stir up an Arab Spring-style revolt. The EC says it took a tough approach in eradicating possible fraud in the electoral rolls.
"The opposition did not lose because of election rigging, it lost because they did not get the vote," EC Chairman Abdul Aziz told Reuters.
Deep concerns over the integrity of Malaysia's elections are nothing new. The government has been shaken by huge street rallies in recent years organized by the influential Bersih (clean) movement that has called for sweeping reforms, including a clean-up of the electoral roll and equal access to media.
After a violent police response to a 2011 rally, Najib burnished his reform credentials by rolling back some draconian security laws and introducing limited electoral reforms.
REFORM DILEMMA
Bersih says those reforms did not go far enough, and is refusing to recognize the election results until it has verified hundreds of allegations of fraud in a "people's tribunal". It has previously highlighted instances of voters more than 120 years old and hundreds of voters living at a single address.
Electoral boundaries that have been manipulated over the years to favor the BN are likely far more influential than fraud. Pro-opposition constituencies in urban areas have up to nine times the number of voters than pro-government seats.
The opposition won just 89 seats in the 222-seat parliament, despite winning more than 51 percent of the vote.
"Najib won on malapportionment rather than his policies to eradicate corruption and reform the economy as voters felt he wasn't sincere," said Ooi Kee Beng, Singapore-based deputy director of the Institute of Southeast Asian Studies.
Najib, the 59-year-old son of a former prime minister, is unlikely to countenance deeper electoral reforms, a move that could be political suicide for the BN.
Reformists within UMNO are urging him, however, to ignore calls for a security crackdown and push ahead with steps to tackle corruption and make the ruling coalition more appealing to urban and ethnic Chinese voters who have deserted it.
"Of course the debate on whether we are truly a majority government will go on. But we can gain respect from the people," said Saifuddin Abdullah, a prominent reformist who is a member of UMNO's Supreme Council.

The PKR strategy director produces police reports on blackouts and phantom voters registered in six addresses.
PETALING JAYA: PKR strategy director Rafizi Ramli provided more evidence on electoral irregularities today.
This time, he touched on the allegations that blackouts occurred in some areas which PKR candidate had lost, a charge the Election Commission (EC) had dismissed.
Speaking at a press conference today, Rafizi produced a police report by a PKR agent, alleging a blackout occurred when ballots were being counted for the Kulim Bandar Bahru parliamentary seat.
The report, lodged by Burhainuddin Ismail, alleged that a blackout occurred at about 7pm, when votes were being counted at thye Sekolah Kebangsaan Sri Lindungan Raja, located in Karangan, Kedah.
“Burhainuddin had also indicated that the blackout only happened in the school building, not the whole area,” said Rafizi.
He added that Tenaga Nasional Berhad (TNB), on their side, has no record of a blackout occuring at the area.
“So the PKR agent suspected that something was amiss and lodged a report on the matter,” he said.
Recently, EC deputy chairman Wan Ahmad Wan Omar dismissed allegations that there were blackouts at certain areas when votes were being tallied.
He also dismissed a photo evidence of the blackout, calling it fake.
On the said photo, Rafizi said that the document was certified as genuine by Sri Serdang candidate, Noor Hanim Ismail, who claimed that the photo was taken at the area she was contesting.
Rafizi also produced copies of five police reports on allegations of the existence of phantom voters.
The reports claimed that there were 46 voters, registered at the only six houses available at Taman Sri Putra, which come under the Kuala Kedah parliamentary seat.
Rafizi added that a voter for the area, Lim Tiek Hong, was issued the Form 10a when he was disallowed from voting as someone else had cast the ballot on his behalf.
Form 10a is a new document issued after introduction of the indelible ink. Lim was given the form after the returning officer found that there no traces of indelible ink on his finger while his name was marked on the list after someone else had voted on his behalf.
“The issuance of Form 10a itself proves that the phantom voters do exist in the electoral system,” said Rafizi.
‘We are not the enemy’
He later urged Wan Ahmad to probe the allegations without fear and favour instead of mocking the allegations.
Rafizi added that Wan Ahmad was constitutionally bound to ensure the electoral process was clear of any irregularities.
“Be open to criticism instead of treating us like an enemy,” he said.
On related matter, Rafizi said that Pakatan Rakyat would file election petitions on several seats by June 10, two days shy of EC’s deadline.
“We would be filing petitions for 20 parliamentary seats while DAP would focus on three.
“As for PAS, I believe they would contest the results on 18 seats, some including several state constituencies,” he said.
On reports that EC would clean up the electoral roll soon, Rafizi urged the electoral body to get an independent team to facilitate the matter.
“They keep giving contradicting statements. When we show evidence that 30 to 40 people were registered in one address, EC tells us that they have no power to delete a name from the electoral roll.
“But when we pointed that blogger Papagomo was registered as a normal voter and a postal voter, they deleted his name within a day. So which is which?” he asked.
Anwar lodges report
Later, PKR supremo Anwar Ibrahim lodged a police report on the indelible ink fiasco at the Tropicana police station.
It is part of PKR’s campaign to get 100,000 people to lodge reports on the indelible ink debacle, after it was found washable just hours after being applied.
PKR president Dr Wan Azizah Wan Ismail also lodged a separate report on the matter.

In GE1994 in Sabah, the 'opposition' in Sabah at that time used to ferry voters from Karamunsing with voting slips, identity slips etc and someone told me a voter voted 22 times from KK all the way up to Tenom in the interiror. I hope this voter would come out and tell us how he did it and Anwar should be aware of this as the operations to churn out voting slips etc were done in an hotel then." This is no secret and yet EC tells us nobody can vote more than once. That is how the opposition in the State grabbed power then.

EC downplays ink fiasco, looking into defects

The quality of ink doesn't determine the victory of any political party, explains the EC deputy chairman.
PUTRAJAYA: The Election Commission today dismissed fraudulent allegations related to the usage of indelible ink during the general election.
“Ink is an added element to the general election, which has an existing strict regulations and law in place,” said EC deputy chairman Wan Ahmad Wan Omar today.
He explained that the quality of the ink does not affect a candidate’s victory or defeat in any election, as the names and identity numbers of the voters will be cancelled by the polling agents upon voting, thus dismissing any fears of phantom voters voting more than once.
“It is impossible for a voter to vote for the second time. There are no duplications in the electoral registration,” he told FMT today.
“EC was surprised when the indelible ink was washable as when we tested it was indelible. However we have formed a committee to study on its defects,” he said.
He also stressed that there was a guide on how the ink should be applied on voters.
“There is a proper way of using the ink… the bottle will have to be shaken and double coat is advised. However, we are unsure if all levels (of election volunteers) adhered to the instructions.”
According to the deputy chairman, the ink went through a stringent process before being implemented in the elections.
“We are looking into the matter for improvisation and the committee will study the defects of the ink and on what actually went wrong.
“Without investigations, we do not want to jump into conclusions.”
“The committee will also ensure that explanations are given pertaining to the defects in the indelible ink”.
Wan Ahmad was responding to allegations that the ink was easily washable, thus making it easy for phantom voters to vote multiple times.
The indelible ink was introduced for GE13 by the Election Commission to fight the menace of phantom voters. According to the EC, the ink will remain on the finger for five days.
The use of the indelible ink was one of the key recommendations of the Parliamentary Select Committee on Electoral Reforms, which was formed after the Bersih 3.0 rally last April.
Earlier today Opposition Leader Anwar Ibrahim lodged a police report over the indelible ink fiasco during the GE.

Anwar: Hypocrite Najib didn’t sign peace deal

The PKR supremo says that he was willing to sign a peace deal with the prime minister, with several conditions, but claimed the latter was unwilling.
PETALING JAYA: PKR supremo Anwar Ibrahim today alleged that it was hypocritical for Prime Minister Najib Tun Razak to accuse him of breaking a peace deal when the latter did not sign on anything.
“I was prepared to sign any pledge if needed but Najib didn’t sign anything.
“So he should be the last person talking about cheating and lying,” said Anwar.
Also present were PKR president Dr Wan Azizah Wan Ismail, vice president Tian Chua and supreme council member R Sivarasa.
On Saturday, Wall Street Journal quoted former Indonesian vice president Jusuf Kalla who claimed that Anwar had reneged on a secret peace deal brokered by him between the PKR leader and Najib.
Anwar, a former deputy prime minister, said that Jusuf had approached both parties individually to broker the peace agreement between the leaders.
“Jusuf came to see me about a month before the general election.
“I agreed to the deal but attached several conditions to it,” he said.
The conditions were that the government should be ethical in its campaigning by not indulging in personal attacks, grant equal access to media, run a free and fair election and ensure a smooth transition of power to the winning party without the risk of political persecution.
“But look at what happened. Did we receive equal access to the media? Or did we have free and fair election?
“So who broke the promise?” asked Anwar.
He also clarified that he had signed the deal on his side but claimed that Najib did not do so.
Queried on whether the negotiations involved a unity government, Anwar replied in the negative.
“Nothing on power sharing or unity government,” said Anwar.
More rallies planned
On another matter, the Permatang Pauh MP also dismissed the notion that the Black 505 rally on Saturday was the last one to be held on the electoral fraud.
“We have yet to cover Perlis, Kelantan, Sabah and Sarawak,” he said.
Queried on PAS deputy president Mohamad Sabu’s call to hold a rally at Dataran Merdeka, Anwar said that the matter was yet to be discussed at the Pakatan Rakyat presidential council.

KOTA KINABALU: The election figures released by the Election Commission are raising eyebrows here.
With Malaysia’s registered voters numbering 13.3 million and the average turnout said to be 80%, this should translate into about 10.6 million votes cast.
But talk among polls watchers and the internet is that the total number of vote slips counted on May 5 was higher than this.
The discrepancy is baffling minds here. Many observers now want the Election Commission, better known as SPR, to explain the discrepancy.
They have also raised questions over the delay in releasing accurate data on the final tally.
Already in Sabah, surprised voters said they were confused by “the very high turnout” when in their view the turnout could be only between 65% to 72%, or even lower in some areas.
A voter here who spoke on condition of anonymity claimed that when he came to vote at about 1.30pm on the polling day on May 5, he found only three or four names underlined (a mark that they had voted) on the same page his name appeared.
“How could it be the turnout was that high … more than 80%?” he asked.
Another voter from Kota Belud who said he came to cast his vote only after 4pm, less than one hour before polls closed, also claimed that he too saw only a few names underlined on the same page his name was on.
“What intrigued me more was that we found out that the counting agents of political parties in certain counting stations were not given a copy of the Form 14 that spells out the final tally for the (various) streams in the polling station.
“I am not sure if the political parties did find out whether the final records announced at the tallying centre in the town were similar to those recorded in the various polling stations,” he said.
These polls watchers also claimed it was difficult for them to audit the overall votes cast during the election but teams are now scrutinising the results as they have been gazetted and are accessible.
“Already we have some very interesting cases in Sabah, as well as in peninsula, for the election judge to see,” said a PKR insider who claimed knowledge of possible election petitions for a few seats in Sabah.
“Wait for Rafizi (Ramli) or our headquarters to say this in a few days or weeks time, that would reveal the fraud people are talking about,” he said adding that SPR itself was in for a surprise from courts findings.

KUALA LUMPUR: Former Indonesian vice-president Jusuf Kalla has accused Datuk Seri Anwar Ibrahim of reneging on a secret deal to respect the outcome of Malaysia's 13th General Election which he brokered between Prime Minister Datuk Seri Najib Razak and the opposition leader.


The Wall Street Journal (WSJ) reported yesterday Jusuf had revealed that a written agreement was made between Najib and Anwar in April, refraining from personal attacks during the campaign and to accept the outcome of the May 5 polls, which was first proposed by Anwar.
 
According to Jusuf, Anwar approached him on the agreement two months ago, asking the latter to reach out to his opponent and secure his commitment for a peaceful election outcome.
 
However, WSJ said Anwar had claimed that Jusuf was the one who reached out to him to offer his assistance in ensuring an orderly outcome to the elections.
 
It reported that Anwar acknowledged he had made the agreement with Najib, with Jusuf as mediator, but he claimed that the Barisan Nasional (BN) had revoked it by the way it ran its campaign.
 
Jusuf also said that he had contacted Anwar, a day after the May 5 polls, to ask the opposition leader to accept the result.
 
"We had a commitment," Jusuf was quoted as saying. "On Monday, I asked Anwar to accept it and look at reality. But they said, 'No, no, no, no."
 
The general election saw Najib-led Barisan Nasional returned to power by winning 133 of the 222 parliamentary seats, which saw the dissatisfied Anwar and Pakatan Rakyat staging rallies across the country since May 8.
 
Without criticising any party, Jusuf said he felt that both sides met their commitment to refrain from personal attacks during the campaign.
 
Jusuf had brokered peace agreements in various conflicts across the troubled Indonesian archipelago during his time as vice-president from 2004 to 2009, and had roles in peace negotiations in Thailand and Sri Lanka. -- BERNAMA

PUTRAJAYA, May 25 (Bernama) - The Barisan Nasional (BN) did not steal victory from the opposition in the 13th general election (GE13), said Prime Minister Datuk Seri Najib Tun Razak.

He said Malaysia practiced a parliamentary democratic system as enshrined in the federal constitution whereby BN had won general elections based on winning more seats to form the government and not based on the popular votes system.


"The claim that we stole victory from the opposition is a falsehood because we did not cheat in the recent GE13.


"Show me the Bangladeshis who became voters? They (opposition) claimed 40,000 Bangladeshis converged on an airport, show which airport? Don't drag a person just because he looked dark like a Bangladeshi," he said when launching the 2013 Youth Festival, here, Saturday.


Also present were former Prime Minister Tun Abdullah Ahmad Badawi, Youth and Sports Minister Khairy Jamaluddin and Communications and Multimedia Minister Datuk Seri Ahmad Shabery Cheek.


Najib said the supremacy and loftiness of the constitution was the main pillar of the nation but the people had avenues to voice their opinions in line with parliamentary democracy.


"Whatever we want to voice out must be centred on the constitution and cannot be done by the roadside by demanding and causing chaos leading to insecurity as it is not in line with the constitution.


"As the younger generation, we must understand the demands for change must be based on the constitution and Rule of Law. If not the law of the jungle will prevail in our country," he said.


At the same time, Najib suggested that the younger generation should think wisely and rationally and not to be taken in by instigation and fraud, specifically in cyberspace.


He said most important in building a nation and future was that it must be based on common sense by picking truth over falsehoods and right over wrong.


"If this can be fostered, if this can be nurtured among youths, God willing our future, the future of the youths and the beloved nation will continue to shine," he said. Najib also gave his assurance that the government was capable of carrying out all changes it had pledged not only for the youths but also for the future of the nation.


"Believe that if you want changes to the nation, it need not necessarily be involved in street gatherings or bringing down what is in existence today.


"What is important we must understand what youths want and we provide the national administration which is suitable for youths," he said.


During the ceremony, Najib also handed out three categories of 2013 National Youth Premier Awards (APBN) which were introduced in 1988, to recognise youths and youth organisations which had contributed towards development of youths in the country.


The Youth Organisation category was won by Malaysian Youth Club (MAYC) of Simpang Bekoh, Melaka which received cash RM50,000, trophy and certificate of appreciation.


Meanwhile, the Male category was won by Malaysian Youth Council's vice-president Manndzri Nasib (repeat:Manndzri Nasib) and the woman's category by Halimah Abd Rahman from Persatuan Puteri Islam Malaysia, Sabah. They each took home cash of RM20,000, a trophy and certificates of appreciation.

156. GE2004, 2008 and 2013 all null and void..illegitimate Govts


OPEN LETTER TO THE HOME AFFAIRS MINISTER, MALAYSIA Datuk Ahmad Zahid Hamidi challenged us to show proof that Electoral Rolls are improper hence affecting the General Elections results.
1.                   Before he would be given proofs, would he declare the General Elections 2004, General Elections 2008 and General Elections 2013 as null and void so that all payments to the elected representatives since 2004 be returned to the nation?  Would he also do it without going to the Courts as GE2004, and GE2008 has lapsed in the context of 21 days (to file) and 6 months to complete court process?  No other excuse  please Mr. Home Affairs Minister (HAM).
2.                   Some of those ruled illegal voters in the N13 Likas’s Election Court Case in 1999 where the Judgement against Yong Teck Lee (the winner) was made, were still in the Electoral Roll in GE2004.  So GE2004 should be declared null and void.  Do it now Mr. HAM.
3.                   The question of Gazette is for you to declare null and void.  There is a ‘stupid’ ruling that a Gazette once published cannot be challenged especially when it is concerned the Faulty Electoral Rolls.  So any Gazette published with wrong/inaccurate information should be considered null and void as Gazette must only contain correct information.  Election Commission declared that some 60,000 voters in Sabah Electoral Rolls were of questioned voters.  So the Gazette and the Electoral Rolls now challenged are both null and void.  So Mr HAM, please declare the GE2013 as null and void.    
4.                   Actually the Gazette for GE2004 P.U. (B) 163  contained errors, hence that Gazette is null and void and 21 days and 6 months are no effect for the results of the GE2004.  Mr HAM, please declare the GE2004 as null and void.  Otherwise this GE2004 can still be challenged by the voters be it in Courts or otherwise.
5.                   Mr. HAM, actually how can EC declared many results for the Parliament and State seats for GE 2004 and GE2008 for the winners when there are great discrepancies in the ballot papers issued.  In P028, the said discrepancy was 4,843 when the Parliament and State seats are compared in the ballot papers issued.  Ask EC to show you this proof and I just to mention it here.
6.                    Since GE2004 and GE2008 had been challenged by me in the High Court not as Election cases especially when frauds were detected, there is no time limits to review such cases.  I would urge Mr. HAM to consider complete review of the cases for GE2004 and GE2008 unless you now declare them null and void.  Was justice delivered by your court simply struck out my cases with costs?
7.                   Now the question before us is the GE2013 which is also loaded with Electoral frauds for various ingredients aforesaid mentioned.  The Electoral Rolls for the whole nation are loaded with project IC holders and such holders are confirmed in the RCI on illegal immigrants. So Mr Ham, are you to declare the GE2013 null and void with or without referring to the EC which is paid to do the ‘refereeing’ job but questioned to the bone?
8.                   Finally, if you and EC are not prepared to declared GE2013 null and void, please let the illegitimate BN Government with a faulty appointment hand over the power to the Pakatan Rakyat to avoid any further  inconvenience or undesirable events in the nation.
The whole nation is quite fed up with the ongoing agitation and the rallies post GE2013 when the majority gave their votes to PR where the Parliament seats majority for the BN could have been manipulated through the ballot boxes.  Could anyone accept that ballot boxes took more than 6 hours to arrive at the counting centre in Kota Kinabalu from a polling centre which is only 10 minutes away?  Was the said boxes manipulated in some ways?  Did EC lodge a Police Report against the news article in the local paper on that allegation of very late arrival of ballot boxes?  I think the ballot boxes and the electoral process in many marginal seats were similarly ‘manipulated’ in one way or another.  I also believe that there is a good practice that final counting could not start until all boxes had arrived.  So why such irregular practice had occurred?  There are also allegations of sudden blackout in some centre.  EC, please tell us why Election Results cannot be declared in daylight hours in the next day after proper checking to avoid any further electoral disputes especially those disputed/challenged cases? The formation of the incoming Government can also wait till next day or so.

Zahid asks for evidence of electoral roll impropriety; says he’ll get to the bottom of it

PUTRAJAYA: Home Minister Datuk Seri Ahmad Zahid Hamidi has urged those with evidence of impropriety in the electoral roll to contact his office directly to get to the bottom of the issue.
He said he is open to working with organisations such as the Centre for Public Policy Studies (CPPS) and the Institute for Democracy and Economic Affairs (Ideas) to get to the bottom of such allegations.
"I welcome any grouses and complaints. If it is true and there is evidence, hand it over to my office and I will set a date and time (for a meeting) with NRD senior officers," he said after a working tour of the National Registration Department here, Thursday.
Recently, CPPS and Ideas released an interim report on the 13th General Election and claimed that alleged impropriety found on the electoral roll used during the polls was not entirely the fault of the Election Commission (EC).
Both organisations pointed out that while it is the EC that approves the electoral roll that will be used, it is the NRD that determines whether or not an individual is qualified to be a voter in the first place.
The NRD comes under the Home Ministry.

Official GE13 results gazetted, 21-day period for petitions begins Thursday


KUALA LUMPUR: The Election Commission (EC) has gazetted the official results of the 13th General Election held on May 5, EC chairman Tan Sri Abdul Aziz Mohd Yusof said.
Following the gazetting of the results, electoral candidates and political parties dissatisfied with the outcome have 21 days to file their objections or petitions.
"The 21-day period begins tomorrow (Thursday), May 23," he said in a statement. The petitions can be filed at the High Courts in the respective states, he added. - Bernama

KUALA LUMPUR, May 23 (Bernama) -- The Barisan Nasional (BN) and opposition parties have 21 days to file election petitions as the Election Commission (EC) has gazetted the official results of the 13th General Election (GE13) on Wednesday.

BN secretary-general Datuk Seri Tengku Adnan Tengku Mansor said the coalition's lawyers were scrutinising the results where the BN won or lost by a slim margin.


Parti Keadilan Rakyat (PKR) vice-president Tian Chua said the party would likely file 27 petitions involving parliamentary and state constituencies, and coordinate the action with the DAP and PAS.


PAS secretary-general Datuk Mustafa Ali said the intended petitions were being studied by a special committee.


On the other hand, the DAP was still contemplating whether to file its petitions to challenge the results of certain seats in GE13.


"We are still in the process of gathering evidence," said its National Legal Bureau chairman Gobind Singh Deo.


In the just concluded GE13, the BN won 133 parliamentary seats while PAS (21), PKR (30) and the DAP (38).

KUALA LUMPUR, May 24 (Bernama) -- Preliminary investigation by the Election Commission (EC) revealed that a photograph posted on the internet showing that a blackout purportedly occurred during vote-counting for the 13th general election (GE13) was an act recorded even before the GE13.

EC Deputy Chairman Datuk Wan Ahmad Wan Omar said this conclusion was arrived at after a thorough scrutiny by him together with his officers.


"They had staged the act even before the election to spread it on the internet as a ploy to show that a blackout had purportedly occurred, whereas it was a lie.


"The photograph showed that EC staff were purportedly counting the ballot papers and had to use a auxiliary lamps whereas the staff were not wearing the EC uniform," he told Bernama when met recently.


He said the most obvious proof was when the photograph showed that there were many reporters and photographers present in the vote-counting area whereas no one was allowed into the area except for the EC staff and agents of the candidates.


"The Standard Operating Procedure (SOP) and work procedure shown on the photograph were totally incorrect...they have forgotten, (they) want to cheat but do not understand the work procedure and were immature.


"In fact the tray used for placing the ballot papers on were also not the EC trays, the material and size were different...(there were) many things in the photograph that did not follow EC SOP," he said.


Wan Ahmad said so far there had been no police report lodged regarding the alleged 'blackout' which showed that it was clearly a slander and concocted story.


"If there had been a blackout, certainly the party agents would have lodged police reports. They represented the candidates, they were present at the counting venues. If there had been a blackout, they would have been the first to lodge police reports, but there were none," he said.


Commenting on an allegation by an opposition newspaper that 24 EC staff in Besut, Terengganu had been confined to mark their ballot papers, Wan Ahmad said he left it to the police to investigate the allegation.


Meanwhile, Wan Ahmad said the proposal by the opposition that a People's Tribunal be set up was dangerous because it ignored the national constitution and law.


"Who will represent the People's Tribunal? Their people, NGO (non-governmental organisation) leaders who have been against the system and the general election all this while? Those who are spreading unhealthy culture to the young generation?" he asked.

Kota Kinabalu: Sabah Progressive Party President Datuk Yong Teck Lee has lodged a report of criminal defamation against individuals and those in the social media about him and the party being supposedly paid RM80 million by the Prime Minister and Chief Minister.
He said the criminal slander was still being spread about him and SAPP.
"Yesterday, I heard from my colleague Datu Shuaib Mutalib that his family's colleagues in offices are still talking about this RM80 juta fitnah. During the general elections, I heard from our colleagues in Kudat (Peter Tsen) and Beaufort (Thomas Chong) the same lie that is spread against SAPP.
The common talk was that I took a taxi to the house of (CM Datuk Seri) Musa Aman to collect the RM80 million cash!" he said in a statement, Wednesday.
Yong said that it was an absolute lie that he and/or SAPP were paid anything by BN or Najib (Umno president) and Musa (Sabah Umno chairman) for whatever purpose.
"The lie was spread by our opponents especially DAP's Dr Hiew King Cheu, and assisted by BN people, to destroy our Sabahans' fight for autonomy," he claimed.
"To succeed in our struggle for autonomy Sabahans must also be self-reliant in our capability, in our economy and in our spirit to fight.
"We will not take any single cent from our enemies and from Malayan parties because to do so would weaken our fighting spirit. We do not need much money to fight elections because we fight on issues, we do not use money politics, we do not buy votes.
"The parties that used a lot of money was BN-Umno which was very obvious and PKR, which even had helicopters to fly to Beaufort, Sipitang, Ranau and PKR people dishing out cash," he said.
"Myself and SAPP are opponents of BN-Umno. SAPP believes that Malaya parties want to treat Sabah and Sabahans like Kerbau Dicucuk Hidung, to make us slaves of Malaya political-economy and to exploit our natural resources to save Malaya which is already bankrupt," he said.
Yong said he was also lodging the report for the police to investigate whether Najib and Musa has committed corruption and other criminal offences, because if it is true about the RM80 million being paid to him (Yong Teck Lee), then it means that corruption and other criminal offences have been committed.

At the current age of 87, former premier Mahathir is running out of time. He needs to position his son, Mukhriz Mahathir, at least as UMNO deputy president before he kicks the bucket. He deliberately lobbied two of his “budak suruhan” (boy-servants), Ibrahim Ali and Zulkifli Nordin, to be fielded as candidates in the 13th General Election, knowing well in advance that they would be roasted like Kenny Rogers Roasters. Both candidates who made headlines due to their racism can only survive in rural UMNO stronghold, not urban Shah Alam nor PAS’s area Pasir Mas. And why would Mahathir send both to the slaughterhouse ?

Mahathir believed BN would win hands down. Opposition would need the help of all the Gods combined in the universe to win the just concluded 13th general election. Based on the strong assumption that more Malays, Indians and Chinese would vote for BN as compared to 2008 tsunami, the hope of regaining two-thirds majority was very real. Hence Mahathir’s dilemma – if Najib could regain the lost two-thirds majority, the latter would be invincible and this will definitely strengthen the then caretaker prime minister’s grip on the throne. He needs to somehow weaken Najib by sending the much tainted Ibrahim Ali and Zulkifli Nordin. Najib can win but cannot do so with a landslide victory.

Meanwhile, Najib thought he would do better than his predecessor sleepy head Abdullah Badawi. Even if he couldn’t regain two-thirds majority, he should have no problem getting more than 140 parliamentary seats achieved by Badawi. He was ill-advised by his team of advisors – that he couldn’t possibly do any worse than Badawi considering the free flow of money, food, beers, sexy ladies, lucky draws and whatnot to the Chinese voters especially in Penang. For the first time in their lifetime, the Chinese were treated like a King and Penang island was transformed into heaven.

Najib also put on Chinese costume and played drum like a clown during Chinese New Year to amuse the Chinese. He believed he was freaking popular with the Chinese and he particularly proud of his “Ah Jib Gor” Chinese name. He promised new Chinese schools wherever he went. Underground betting was also doing brisk business with RM100 win for RM1 bet in favour of Lim Guan Eng’s defeat. According to rumour mill, the stake was so high that you can sell your vote for as much as RM6,000 a piece in Penang. Then came the mega crowd to almost every single opposition’s ceramah.

But these opposition ceramahs attracted mainly the Chinese especially towards the end of the campaign period. With every new ceramah, the Chinese participants increased greatly. While Najib rubbished such pattern as a new threat, Mahathir was quite worried about the Chinese swing. That was why he put on “TSI” (Turbocharged Stratified Injection) mode and screamed every day till foam at mouth about Malay losing power. If Mahathir did nothing, the rural Malays could have given landslide victory to opposition. Najib would be biting his index finger in disbelief till today. Still, Mahathir miscalculated the quantum of the Chinese swing.

The swing of Chinese votes easily breached 90% in most of the constituencies, something which is as rare as finding dinosaur fossils in Malaysia. So whileMahathir lied about not expecting Najib to do worse than Abdullah Badawi, he was honest about didn’t expect the Chinese to dump BN in such a scale. That was why he was emotional and upset about the Chinese, so much so that he didn’t hold back in accusing the Chinese “rejected the hand of friendship” extended by (UMNO) Malays, never mind it was not true in the first place. He was seen openly and deliberately provoking Malays against the Chinese. Obviously it would be to BN’s advantage if Malays start to distrust the Chinese.

Najib needs to survive his next test – UMNO election – hence his parroting about ungrateful Chinese was expected. Actually, Najib is still in a daze, not knowing the root cause of the Chinese’ rejection despite all the goodies and entertainment given to them (*grin*). You don’t need to be a genius to predict that Chinese will once again become UMNO’s punching bag in its coming general assembly. In fact, Mahathir thought it would be a waste of time to recapture Chinese votes by way of sweet-talk them. If the only way to divide the Malays and Chinese is to play racist card again, so be it. The Chinese needs to be intimidated in order for them to go back in droves to BN’s arm like herd of sheep.

Anwar Ibrahim realizes that Mahathir’s latest extreme racial game will have a huge impact on his coalition and he needs to diffuse it fast. If the Chinese do not get the backing from their Malay comrades, they would be too scare to throw their support for PR again in the future. Pakatan Rakyat would be history come next 14th general election. That was why Anwar called for a mega rally, the first after election, to rubbish the “Chinese Tsunami” scare tactictrumpeted by both Mahathir and Najib. Some speculated the reason why police flip-flop about permit requirement for yesterday’s rally, held in Kelana Jaya stadium, was to embarrass Anwar Ibrahim as the spooked Chinese and partners, DAP and PAS, would most probably not present.

However, despite last minute notice, the stadium was packed to the brim.Social media research group Politweet.org estimated the crowd size in and around the stadium at between 64,000 and 69,000, given that the stadium capacity is about 25,000. Some claimed there were easily 100,000 people who answered the call last night, with thousands more stuck in traffic and couldn’t make it to the stadium. If Anwar and Najib administration’s objective was to test the waters as to the relevance of Pakatan Rakyat post 13th general election, the people particularly the young chaps have overwhelmingly given their endorsement to the leadership of Anwar to continue the struggle, judging from Wednesday’s mind-boggling success.

Psychologically, Anwar Ibrahim knew Najib administration would be very careful not to add fuel into the already furious opposition supporters. It would be suicidal to deploy police or FRU and start arresting the public, or to spray them with water cannon, and in the process agitates the situation. It’s always better to let these frustrated people scream till their lungs burst in the stadium. They need to release their steam. Anwar was actually praying for a police crackdown, the more brutal the better, because then he can easily put the blame on Najib’s administration and attracts more sympathizers. Too bad Najib didn’t give Anwar the bullet.

Anwar can now replicate the same rally to other towns throughout the country in order to push the momentum going. Armed with 51.4% of popular votes against BN’s 48.6%, Anwar is set to spread the message of PR’s victory being stolen. Anwar knows that the “flames of desire”amongst the youngsters is his only hope if he still wish to become the country’s 7th prime minister. If there’s one person who knows how to rally people by taking advantage of their sentiments, that person has to be Anwar Ibrahim. Pakatan Rakyat can also take comfort from White House’s congratulatory announcement that comes with a note about irregularities.

As much as Mahathir hates to admit it, this war is far from over. Unless PAS or DAP defects from the current coalition, the future doesn’t look good for BN, if they still intends to recapture Selangor or Penang state. Just like the excessive parties thrown in by BN during the campaign, playing too much racism toys could backfire badly. Mahathir made his biggest mistake by picking Anwar Ibrahim from Abim movement (Angkatan Belia Islam Malaysia) to be nurtured as future prime minister. Will he make another fatal mistake by playing racial card only to unite all the multiracial technology-aware voters instead ?

Do you know why Anwar tweeted that his coalition PR has won the election just after two hours into the counting process? On its own, PR couldn’t posibly win the election. At best, it could force BN into chaos with a single digit majority win. What gave Anwar the confidence of tweeting such message was hispact with Sarawak and Sabah greedy politicians in the BN coalition. Anwar had been having tons of meetings with these politicians especially the corrupted Sarawak Chief Minister. With double digits frogs ready to jump, depending on the “rewards”, Anwar was damn sure he would be the country’s 7th prime minister.

Again, Anwar couldn’t keep his cool and his early tweet raised red flags. BN’s war room’s director Mahathir was notified of this troubling tweet message and the old fox decided to triple BN’s insurance coverage. Massive frauds or not, BN just couldn’t take lightly of Anwar’s tweet hence the extraordinary delay in releasing the results. That was why you saw only the BN’s parliamentary scoreboards kept churning new score while the opposition PR’s own scorecard practically didn’t move at all. In certain seats, requests for recount was ignored totally. The priority was to ensure Election Commission announce officially that BN has win the election with comfortable majority seats. Thereafter PR can have the remaining leftovers (*hats off to genius BN*).

Nevertheless, Mahathir was right when he questioned Najib’s strategists, whose ideas may have contributed to BN’s poor performance. If only Najib has strategists such as DAP’s Liew Chin Tong – one of the brilliant architects who proposed and justified that the war should be brought to BN’s stronghold, Johor. But considering how Najib was obsessed with becoming popular as if he was running for the President of the United Malaysia, it wasn’t hard to guess what type of strategists that fit his bill. Najib’s advertising and marketing method was “overkill” to the extent people got sick and tired with its propaganda.

Najib and Mahathir should realize that by cursing and victimizing the Chinese is not a long-term solution, unless of course they’ve given up on their future votes in totality. Still, what do they plan to do next? Close all the Chinese schools, force all of them into unemployment and stop providing them electricity, gas and water as punishment for being naughty? And in return the Chinese stop paying taxes? Gimme a break. It’s better to hedge on more funds – Malays, Chinese and others – rather than to burn the bridge with the Chinese and rely on one less fund in its next general election.

Najib administration has to remember that urban Malays were also in the same boat as the Chinese in rejecting his coalition. It’s time for BN to really ponder on its next course of direction. Will there be more Bersih 4.0 till version 8.0 rallies, assuming it would be an annual event? Surely Ambiga knows Election Commission would not give a hood even if they organize rallies on weekly basis. Perhaps overwhelming internationally political pressure could move the stubborn Election Commission.
